"..... paid time off counts against the normal 40 in the work  
week." .....

I'm confused. Surely the law requires overtime rates of pay after 40  
hours WORKED in one week, not after 40 hours PAID per week.

We often pay for 40 hours, even though the employee has only WORKED  
for 32 hours. He took one day off as a vacation day. If he WORKED more  
than 32 hours, we certainly would not pay him overtime merely because  
he was PAID 40 hours.
